Seul le constructeur automobile peut vendre ces articles aux diff\u00e9rents ateliers de r\u00e9paration, ce qui lui conf\u00e8re <strong>un monopole l\u00e9gal sur la vente de pi\u00e8ces autos<\/strong>, car ces ateliers doivent s&#8217;approvisionner aupr\u00e8s des fournisseurs du constructeur.<\/p>\n\n\n\n<p class=\"has-text-dark-color has-text-color\">L&#8217;Autorit\u00e9 de la concurrence fran\u00e7aise recommande depuis 2012 une ouverture progressive et prudente du march\u00e9 des pi\u00e8ces autos d\u00e9tach\u00e9es visibles pour la r\u00e9paration. Dans de nombreux pays de l&#8217;Union europ\u00e9enne, l&#8217;orientation de la &#8220;clause de r\u00e9paration&#8221; a d\u00e9j\u00e0 \u00e9t\u00e9 inscrite dans la loi.<\/p>\n\n\n\n<p class=\"has-text-dark-color has-text-color\"><strong>Depuis 2017, la F\u00e9d\u00e9ration de la distribution automobile (FEDA) coop\u00e8re avec le gouvernement et les parlementaires pour obtenir le retrait des pi\u00e8ces autos d\u00e9tach\u00e9es visibles dites &#8220;captives&#8221;<\/strong>. L&#8217;industrie automobile restera dynamique apr\u00e8s que cette r\u00e9forme entam\u00e9e en 2019, aura entra\u00een\u00e9 une baisse du co\u00fbt des pi\u00e8ces autos. L&#8217;objectif est d&#8217;en faire b\u00e9n\u00e9ficier le consommateur.<\/p>\n\n\n\n<p class=\"has-text-dark-color has-text-color\">En 2019, la loi d&#8217;orientation des mobilit\u00e9s a d&#8217;abord inclus la lib\u00e9ration des pi\u00e8ces d\u00e9tach\u00e9es, puis en 2020 la loi ASAP l&#8217;a concr\u00e9tis\u00e9, mais par deux fois le Conseil constitutionnel l&#8217;a censur\u00e9.<\/p>\n\n\n\n<p class=\"has-text-dark-color has-text-color\">Le 13 ao\u00fbt 2021, le Conseil constitutionnel a valid\u00e9 un amendement au projet de loi Climat et R\u00e9silience qui comprenait le m\u00eame dispositif. La loi sur le climat et la r\u00e9silience apporte deux changements importants \u00e0 la loi sur le design et le droit d&#8217;auteur. <strong>A partir du 1er janvier 2023, l&#8217;achat de pi\u00e8ces automobiles visibles sera partiellement ouvert \u00e0 la concurrence.\u00a0<\/strong><\/p>\n\n\n\n<p class=\"has-text-dark-color has-text-color\">Tous les \u00e9quipementiers, qu&#8217;ils fabriquent ou non des vitres de v\u00e9hicules (pour les v\u00e9hicules neufs), peuvent commercialiser des pi\u00e8ces de vitrage. Par cons\u00e9quent, la loi ne concerne que les dessins et mod\u00e8les enregistr\u00e9s \u00e0 partir du 1er janvier 2023 et leur conf\u00e8re une dur\u00e9e de protection de 10 ans.<\/p>\n\n\n\n<p class=\"has-text-dark-color has-text-color\"><strong>\u00c0 partir du 1er janvier 2023, la dur\u00e9e des dessins et mod\u00e8les enregistr\u00e9s pour toutes les pi\u00e8ces automobiles de r\u00e9paration sera de 10 ans.<\/strong><\/p>\n\n\n\n<p class=\"has-text-dark-color has-text-color\">Un \u00e9quipementier qui a fabriqu\u00e9 la pi\u00e8ce &#8220;d&#8217;origine&#8221; peut concurrencer le fabricant pour la vente de pi\u00e8ces d\u00e9tach\u00e9es, \u00e0 condition que les dessins et mod\u00e8les des pi\u00e8ces d\u00e9tach\u00e9es (autres que le vitrage) soient dans le domaine public apr\u00e8s plus de 10 ans, et qu&#8217;ils puissent \u00eatre reproduits et vendus en toute l\u00e9galit\u00e9.<\/p>\n\n\n\n<p class=\"has-text-dark-color has-text-color\">Une harmonisation compl\u00e8te du march\u00e9 des pi\u00e8ces de rechange en Europe est en train de prendre forme, car elle est d\u00e9j\u00e0 l\u00e9galement requise dans de nombreux Etats membres. Une d\u00e9marche qui existe d\u00e9j\u00e0 en pratique aux Etats-Unis.
